Marc Morano: “You got to give the Biden Administration credit. It’s a lot easier to destroy America than it is to build America up, and they are doing a great job on the way out the door. They’re showing true competence at something.”
Morano: “It’s an amazing thing. Biden has found a bureaucratic loophole — and one of the things Washington is good at is issuing regulations, particularly arcane regulations that require lawyers, legal expertise, years of paperwork, and courts to figure out. That’s how they’re able to do this again. They’re showing great competence at destroying American Energy, and you have to give him some Evil Genius credit for that.”
Morano: “It’s a regulatory nightmare now, at the very least, Joe Biden has just made it so that the cost of doing business, the cost of any project off our coast, has gone astronomically up. Keep in mind you can still build all the offshore windmills you want. We’re at 13 whale deaths in 30 days.”

An attempt at a swift annulment, however, might be more complicated than a mere new executive order. Biden’s use of the 1953 Outer Continental Shelf Lands Act means the last-minute executive order supposedly enjoys unique protections that cannot simply be undone by a reverse order. According to Bloomberg News, the 1953 law “included a provision giving presidents wide discretion to permanently protect waters from leasing, but it didn’t explicitly grant them the authority to undo those designations.” … In 2019, a federal district court judge rejected Trump’s attempt to undo protections implemented under the law by President Barack Obama. Those protections covered more than 125 million acres of the Arctic and Atlantic Oceans. … “I don’t think the issue has been totally resolved by the courts,” Jason Hill, a law partner at Holland & Knight, told The Federalist. … NBC reported on Monday that Biden’s use of the Outer Continental Shelf Lands Act, however, means “it may take an act of Congress to reverse Monday’s announcement.”
